The agreement
These Terms of Sale govern your purchase of a license to a photograph from Heighten Studios. By completing checkout you agree to these terms. The specific license you purchase determines what you may do with the file you receive.
Copyright in all photographs remains with Heighten Studios. A purchase grants you a non-exclusive, non-transferable license on the terms set out for the specific tier you purchased; it does not transfer copyright.
Delivery
Files are delivered as digital downloads. After successful payment, a download link is emailed to the address you provided at checkout, and is also shown on the post-purchase confirmation page. Download links are valid for 7 days from purchase.
EU consumer law: right of withdrawal
Where applicable under EU consumer law, you have a 14-day right of withdrawal for digital content. Because we deliver the file to you immediately, you waive this right at checkout in exchange for immediate access. If you do not wish to waive this right, do not complete the purchase.
Refunds
See our Refund Policy. In short: we don't refund digital downloads after the file has been delivered, except for duplicate charges or verifiable technical issues.
License tiers
The full terms of each license tier are below. The terms applicable to your purchase are those of the tier you bought.
Personal Wallpaper
$5 USDPersonal device backgrounds. Not for resale or commercial use.
Permits use of the file as a personal background on devices you own (phone, tablet, desktop). Does not permit redistribution, resale, public display, printing for sale, or any commercial use. Single-buyer license; non-transferable.
Web Use
$50 USDOne website or social account. Up to 2000px. No print, no resale.
Permits display of the file on a single website, blog, or social account at sizes up to 2000px on the longest edge. Does not permit print use, resale, sublicensing, NFT minting, or use as training data for machine learning models. Single-entity license; non-transferable.
Print Use
$150 USDSingle print project up to A2. Personal or editorial use.
Permits printing the file once for a single personal or editorial project at sizes up to A2 (594 × 420 mm). Does not permit print runs for resale, commercial advertising, or product packaging. Single-entity license; non-transferable.
Full Commercial
$500 USDWorldwide commercial license, single brand. Advertising, packaging, web, and print.
Permits worldwide use of the file in commercial contexts — advertising, product packaging, web, print, and out-of-home — by a single brand or entity. Does not permit sublicensing, resale of the file itself, NFT minting, or use as training data for machine learning models. Single-entity license; non-transferable.
Liability
To the fullest extent permitted by law, Heighten Studios' total liability arising out of or relating to a purchase is limited to the amount you paid for that purchase.
